CMS updates Open Payments data

On January 20, 2023, the Centers for Medicare & Medicaid Services (CMS) refreshed Open Payment data for program Years 2015 through 2021 to reflect changes to the data that have been made since the 2021 Program Year data was published in June 2022. The updated dataset is now available for viewing at openpaymentsdata.cms.gov.

What is the Open Payments Database?

Under federal law, drug and medical device manufacturers are required to report their financial interactions with physicians – including consulting fees, travel reimbursements, research grants and other gifts. Any payments, ownership interests and other “transfers of value” are reported to the Centers for Medicare and Medicaid Services (CMS) for publication in the public Open Payments database.

Open Payments data is published annually by June 30, and physicians are able to preview the data attributed to them during a 45-day, pre-publication review and dispute period that runs from April 1 to May 15. Physicians are encouraged to review the data attributed to them during the review period.

CMS refreshes the Open Payments data annually to include updates from disputes and other data corrections made since the initial publication of the data. 

The refreshed Open Payments Data Set includes:

  • Record Updates: Changes to non-disputed records made on or before November 15, 2022, are published.
  • Disputed Records: Dispute resolutions completed on or before December 31, 2022, are displayed with the updated information. Records with active disputes that remained unresolved as of December 31, 2022, are displayed as disputed.
  • Record Deletions: Records deleted before December 31, 2022, were removed from the Open Payments database. Records deleted after December 31, 2022, remained in the database, but will be removed during the next data publication in June 2023.

New California Open Payment Notification Requirement

Physicians are reminded that a new California law took effect January 1, 2023, that requires California physicians to provide patients with a written or electronic notice about the availability of the federal Open Payments database. It also requires physicians to post in their offices and on their websites a notice informing visitors about the Open Payments database, which can be used to search payments made by drug and medical device companies to physicians, physician assistants, advanced practice nurses and teaching hospitals.

To assist physicians with this new requirement, the California Medical Association (CMA) has published sample forms and notices available at cmadocs.org/open-payments.

NOTE: Scheduled System Outage

In preparation for Program Year 2022 data submission, the Open Payments system will be unavailable from Friday January 27, 2023 to Monday January 30, 2023.
